Caregiver Services Agreement (Independent Contractor)

Why This Agreement Exists Plan Heal Earn™ provides structured tools, resources, and optional pathways designed to support family caregivers emotionally, practically, and financially — without replacing clinical care or creating employment relationships. This agreement exists to clearly define boundaries, protect caregivers, and ensure transparency before any optional EARN-related tools or services are used. Most caregivers review this agreement after exploring PLAN and HEAL and before choosing to use EARN tools.1. Parties
This Caregiver Services Agreement (“Agreement”) is made between [Company/Client Name] (“Company/Client”) and [Caregiver Full Name] (“Caregiver”), effective [Date]. The Company/Client engages the Caregiver to provide non-medical, compassionate caregiving services to the individual(s) named in this Agreement.
2. Purpose & Scope
Plan Heal Earn™ connects professional and family caregivers with remote-work opportunities and caregiver-support platforms. This Agreement governs participation in the Plan Heal Earn™ network and defines responsibilities for both parties.The purpose of this Agreement is to clearly define the duties, responsibilities, and payment terms for caregiving services performed at [Service Location] for [Care Recipient Name]. Services are designed to support the client’s comfort, dignity, and quality of life while maintaining independence at home.
3. Time Clock Compliance, Schedule & Hours
- Contractor agrees to accurately record working hours through the Plan Heal Earn™ digital time-clock system. Hours logged will be accessible to the partnered company for verification and payment.
- Typical schedule: Up to 20 hours per week, based on mutually agreed times.
- Caregiver agrees to arrive promptly and report any schedule changes in advance.
- Overtime or additional shifts must be pre-approved by the Company/Client.
- Meal and rest breaks will be taken as required by state regulations.
4. Services Provided
Caregiver agrees to provide non-medical assistance with activities of daily living, including but not limited to:
- Personal care (bathing, grooming, dressing, toileting assistance)
- Meal preparation and light housekeeping
- Mobility support, transfers, and fall prevention
- Medication reminders and appointment coordination
- Companionship and emotional support
- Transportation to appointments or errands, if authorized
5. Timekeeping, Notes & Compliance
Caregiver must record all work hours using the digital Caregiver Time Clock located on the Earn Page. Each entry must include start/stop times, tasks performed, and compliance checkboxes for safety, privacy, and care plan adherence. Falsifying time records or notes is grounds for termination.
6. Compensation & Invoices
Partner companies will pay caregivers directly. Plan Heal Earn™ does not process payroll but may charge an optional monthly platform access fee ($29–$49) for technology, training, and community support. The Caregiver will be compensated at an agreed hourly rate of $[Rate]. The system automatically applies the correct rate based on caregiver-company pairing. Invoices can be generated by date range and printed directly from the platform. Payment is due within [7–14 days] of receipt unless otherwise stated in writing.
7. Intellectual Property, Ownership, & Professional Standards
All systems, tools, and processes provided under this Agreement remain the sole property of Plan Heal Earn™ and The Ultimate Caregiving Expert. Contractor has no ownership or usage rights beyond their engagement.Caregiver agrees to uphold the highest standards of care, including:
- Maintaining client confidentiality at all times.
- Following infection control and safety practices.
- Communicating promptly about incidents, falls, or changes in condition.
- Respecting the client’s home, belongings, and boundaries.
- Maintaining a neat appearance and professional attitude.
8. Independent Contractor Status
The Caregiver is an independent contractor, not an employee. The Caregiver is responsible for taxes, insurance, and compliance with all applicable laws. The Company/Client does not provide employee benefits, workers’ compensation, or liability insurance for contractors.
9. Resale and Transferability
Plan Heal Earn™ retains the right to transfer, sell, or license its platform, contracts, and brand assets. This Agreement remains valid and binding under any future owner.
10. Termination of Agreement
Either party may terminate this Agreement with [7 days] written notice. Immediate termination may occur for breach of confidentiality, neglect, abuse, falsification of time records, or unprofessional conduct.
10. Confidentiality & Privacy
Caregiver agrees to maintain strict confidentiality regarding all client and family information. No photos, videos, or social media posts involving the client are permitted without written authorization.
11. Liability & Safety
The Caregiver assumes responsibility for safe conduct during all services. The Caregiver agrees to report safety concerns immediately and to avoid any tasks beyond their physical capability or training. The Company/Client is not responsible for accidents resulting from Caregiver negligence or non-compliance.
12. Governing Law
This Agreement is governed by the laws of the State of Florida, and any disputes will be handled in the jurisdiction of [County, FL].
13. Entire Agreement
This Agreement represents the entire understanding between the parties and supersedes any prior discussions or arrangements. Any amendments must be made in writing and signed by both parties.
